U.S. Senator Todd Young (R-Ind.) has joined over 100 colleagues in filing an amicus brief in the U.S. Supreme Court supporting Louisiana’s lawsuit to protect women and their unborn children from dangerous mail-order chemical abortion drugs. The brief argues mifepristone’s in-person dispensing requirement must be reinstated.
“I’m proud to join with my Congressional colleagues in filing this amicus brief in the Supreme Court in support of protecting women and children from dangerous mail-order chemical abortion drugs,” Sen. Young said.
The brief is supported by U.S. Senators Bill Cassidy (R-La.), Jim Banks (R-Ind.), Marsha Blackburn (R-Tenn.), Katie Boyd Britt (R-Ala.), Ted Budd (R-N.C.), John Cornyn (R-Texas), Tom Cotton (R-Ark.), Kevin Cramer (R-N.D.), Mike Crapo (R-Idaho), Ted Cruz (R-Texas), Steve Daines (R-Mont.), Deb Fischer (R-Neb.), Lindsey Graham (R-S.C.), Josh Hawley (R-Mo.), John Hoeven (R-N.D.), Cindy Hyde-Smith (R-Miss.), James Lankford (R-Okla.), Roger Marshall, M.D. (R-Kan.), Jerry Moran (R-Kan.), Rand Paul, M.D. (R-Ky.), Pete Ricketts (R-Neb.), James Risch (R-Idaho), Rick Scott (R-Fla.), Tim Sheehy (R-Mont.), and Tommy Tuberville (R-Ala). U.S. Speaker of the House Mike Johnson (R-La.) also joined the brief.
In October 2025, Louisiana and Rosalie Markezich, a victim of the removal of the in-person dispensing requirement for dangerous chemical abortion drugs, filed a lawsuit to overturn the illegal policy. Because of President Biden’s policy, Rosalie’s boyfriend was able to order chemical abortion pills online from an abortionist in California and coerced her to take the drug to kill her unborn child. The Republican lawmakers argue that the Biden Administration violated federal law by removing the in-person dispensing requirement, and that these protections should be reinstated.
Last week, the U.S. Court of Appeals for the Fifth Circuit sided with Louisiana, issuing an order that put the in-person dispensing requirement back into place while the litigation continued. The amicus brief asks the Supreme Court to uphold the Fifth Circuit’s decision.
