Senator Jim Banks (R-Ind.) introduced on Thursday the Restoring Biological Truth to the Workplace Act.

According to Sen. Banks, across the country, including in Indiana, employees have been wrongfully fired, penalized, and discriminated against in the workplace for dissenting from radical gender ideology. This legislation works to restore common sense in the workplace by protecting those who express the truth about biological sex under Title VII of the Civil Rights Act of 1964.

“This bill is about protecting common sense,” Sen. Banks said. “Americans shouldn’t fear losing their jobs simply for acknowledging the basic reality of biological sex.”

Key provisions of the bill

  • Clarifies that Title VII protects employees who express the binary nature of sex, whether inside the workplace or outside of it.
  • Clarifies that Title VII protects the right of employees to use single-sex bathrooms and changing areas in the workplace.
  • Establishes penalties for employers that retaliate against any employee who speaks out against discrimination based on the rights above.
  • Bars employers from using pretexts to violate these rights.
