Rep. Spartz: President Biden lacks legal authority for vaccine mandate

This week, the Subcommittee on Civil Rights of the House Education and Labor Committee held a joint hearing on President Biden’s vaccine mandate on employers with 100 or more employees. This directive is included in President Biden’s “Pathway out of the Pandemic” plan and directs the Occupational Safety and Health Administration (OSHA) to implement the mandate.

Congresswoman Spartz questioned the witnesses about the constitutionality and legality of the federal mandate raising concerns with the ability of the federal government to mandate an individual losing their private-sector job, presidential authority to issue a broad vaccine mandate without action from the legislative branch, and OSHA’s misinterpretation of the statute dealing with “toxic substances.”

“The issue of President Biden’s employer vaccine mandate was raised by many of my constituents during my town halls last weekend,” Rep. Spartz said. “We need to remember that this mandate not only raises questions about constitutionality and presidential authority but will also have a direct effect on people’s lives and livelihoods. Generally, top-down government approaches do not work and backfire.”

In addition to this week’s joint subcommittee hearing, Congresswoman Spartz also signed a Sept. 29 letter to U.S. Secretary of Labor Marty Walsh requesting that the Department of Labor immediately suspend work on the national vaccine mandate. Read the full letter here.
