According to a Sheriff’s Office report, a deputy patrolling on 96th Street stopped to check on a gray Honda Pilot along the side of the road. The female occupant in the driver’s seat appeared to be asleep with a seat belt on as the deputy also noticed what appeared to be vomit on her shirt. Concerned for the woman’s welfare, the deputy made contact with the occupant and noticed an odor of an alcoholic beverage coming from her as they spoke. She agreed to field sobriety tests and was taken for a certified breath test that showed a breath alcohol level of 0.155.

The sole occupant of the vehicle, identified as Diane Katherine Morris-Mack, 44, Fishers, was arrested on a charge of Operating While Intoxicated with a BAC Greater than 0.15. She was released from the Hamilton County Jail on Thursday afternoon with an initial court appearance scheduled for Wednesday, Nov. 1.

During the course of the investigation, a Lawrence Police Department badge and other items were found. Lawrence Police officers have retrieved those items.

The incident has been turned over to the Hamilton County Prosecutor’s Office for a final determination of charges. Requests for any further information in the case should be directed to that office.

A charge is merely an accusation. All subjects are innocent unless or until found guilty in court.
